Civil Union Inadequacies..

June 18th, 2007 7:59 pm MDT

Hi Gang, Just wangted to share some news on the civil union front. The NY Times posed an opinion piece that all should read. Call on Plessy V Ferguerson arguments of Separate but equal..very good stuff! The Link and the Story are below... http://www.nytimes.com/2007/06/07/opinion/7thu3.html?ex=1338868800&en=741609e6aa8c3d5d&ei=5124&partner=permalink&exprod=permalink EditorialThe  Inadequacy of Civil UnionsPublished: June 7, 2007 A potentially groundbreaking legal battle over Connecticut’s exclusion of gay people from the state’s marriage law has catapulted the debate over same-sex marriage to a new level. Appearing last month before the state’s highest court, a lawyer representing eight same-sex couples led a spirited attack on Connecticut’s refusal to grant gay couples the freedom to marry. He also challenged the notion that civil union laws — like those enacted in Connecticut, New Jersey, Vermont, and most recently New Hampshire — are a constitutionally adequate alternative. The plaintiffs’ argument was laced with references to Plessy v. Ferguson, the U.S. Supreme Court’s notorious 1896 decision which justified racial segregation under a deplorable standard of “separate but equal.” Although startling, the analogy is apt. In establishing civil unions two years ago, Connecticut lawmakers created a separate and inherently inferior institution that continues to deny gay couples the equality they seek and deserve. Connecticut would seem a particularly hospitable place to advance this equality claim. In addition to requiring equal treatment for individuals in comparable circumstances, and barring sex-discrimination, Connecticut’s Constitution explicitly forbids gender-based “segregation.”State lawyers answer that the basis for the exclusion is not gender but sexual orientation, a category not covered by existing antidiscrimination provisions. That is true, but forbidding marriages when one partner is the wrong gender still adds up to sex discrimination. The state also asserts that the civil union law grants all the rights of marriage to same-sex couples, and any difference amounts to “a difference in name alone.” A trial court judge bought that argument and dismissed the case last year, saying the plaintiffs suffered no legal harm.Saying a civil union is the same as marriage does not make it so. Civil unions are a newly invented category, neither universally recognized nor understood. Connecticut’s claim that the two terms are alike merely underscores the bottom-line question: Why relegate a minority group to a separate category? The court case has helped stall this issue in Connecticut’s Legislature. But if the ruling goes against the couples involved, the Legislature will have a duty to revisit the matter. A law that allows civil unions but not marriage is preferable to denying benefits and recognition to same-sex couples. But no one should confuse it with equality.

Dealing with Loss...

June 7th, 2007 10:12 am MDT

Hey Gang, So on balance this has been a frustrating year. Moving forward with transistioning has been slower than anticipated, I lost a job i held for more than seven years, financial difficulties, and I have just learned someone I've been freinds with for quite some time has passed away. http://profiles.urnotalone.com/SlaveGirlToniToni was pretty quiet community wise and apprantly she left us a few weeks ago. Toni was a good person and worked for the government. She even had to go into protective custody as she was a whistleblower in a corruption case here in Connecticut. With her gone, and everything else this year, I find myself reflective today about life and how short it can be. I find my patience wearing thin in trying to manifest change. I find myself itchy to live life to the fullest! Its hard to believe that so many things have changed in such a short period..yet I don't feel sad right now, a little nervous about what the future holds, but not sad. Anyhow, these are random thoughts floating thru my head.Hope this note finds, YOU well!Victoria

Stand with Stanton!!!!

March 8th, 2007 8:56 pm MST

Less than a week after Largo City Manager Steve Stanton announced he was transgendered, the small Florida community's city commission fired him*. This is workplace discrimination, plain and simple. I just signed the 'Stand with Stanton' petition, and I hope you will too: http://nsrc.sfsu.edu/Petition.cfm

When the Commission fired Stanton, they ignored his excellent record as an energetic and effective leader. Stanton has received consistently positive performance reviews from the City Council and the Mayor while managing over 1,200 employees and the city's $130 million budget.

The promise of America is that if you are a good employee, you should be rewarded for it regardless of your race, creed, disability, gender or sexual orientation. Stanton's firing was an un-American display of workplace discrimination and this injustice should be reversed. Sign our 'Stand with Stanton' petition that we'll deliver to the City Commission in Largo, FL.

Transvestite killings on the rise in Guatemala

November 24th, 2006 8:54 am MST

Transvestite killings on the rise in Guatemala
By Mica Rosenberg
GUATEMALA CITY (Reuters) - Two transvestites were shot dead in broad daylight on Wednesday, their bodies riddled with bullets in the latest in a wave of suspected hate crimes in Guatemala.
The transvestites, in their 20s, were gunned down together outside a bar in the crime-ridden Villanueva neighborhood of the capital. They were shot in the face and body.
"They both had long hair and long nails, men dressed as if they were women," said emergency worker Oscar Sanchez. At least 15 bullet casings lay on the ground at the murder scene.
Hate crimes have grown this year in Guatemala, an often macho and extremely violent society still scarred by a long civil war that killed 200,000 people and ended 10 years ago.
Oasis, a gay rights group, said 11 transgender people have been murdered so far this year, compared to seven the year before, and no one has been arrested for the crimes.
Gabriel Ixcoy, an 18-year-old transgender prostitute known as Shakira, was shot dead in September for refusing the sexual advances of a young gang member. He reportedly cut out Shakira's tongue.
Guatemala is one of the most violent countries in Latin America with over 5,300 people murdered in 2005 -- a murder rate of around 40 per 100,000 people. The rate in the United States is 5.6 murders per 100,000, according to the While the number of Guatemalan transvestites killed is minimal compared to the overall murder figure, rights workers are increasingly focusing on the killings of women, gays and other vulnerable groups.
POLICE INVOLVED
Police are rarely interested in finding the killers of transvestites and are sometimes involved themselves, gay rights activists say.
In December last year, Juan Pablo Mendez, or Paulina, was killed and another transgender prostitute was wounded by three people witnesses identified as uniformed police officers.
"The general level of violence in Guatemala has increased exponentially over the past few years with most crimes going unpunished," said Sebastian Elegueta, a Central America researcher for Amnesty International.
"But it's the most vulnerable groups in society, like women, sex workers or transgender people, that are targeted first and those that are afforded the least amount of protection from the state," he said.
Oasis Director Jorge Lopez said transsexuals are particularly at risk because the majority work as prostitutes, trawling the dangerous streets of Guatemala's old city in short mini-skirts, wigs and platform heels.
"Transgender people end up in sex work because they've been kicked out of their homes, their schools, their jobs," said Lopez. "The only options left for them to make a living is prostitution or working in a hair salon."
Many of the transvestite prostitutes loitering on the corners of the capital come from other Central American countries, said Lopez.
"People throw eggs at us, call us names, shoot at us," said Claudia, a 21-year-old Nicaraguan transgender prostitute out on a corner past midnight in black fishnet stockings, a ruffled white skirt and bright blue eye shadow.
"The police are the worse. They sometimes force us to rob clients so they can take their cut," she said.

Trangendered man's killer gets life....

Transgender man's killer gets life
The two left a nightclub together shortly before the 2003 slaying. The Largo man was arrested days later.

--------------------------------------------------------------------------------

LARGO - A Largo man who stabbed a transgender man to death after the two left a Clearwater nightclub together was sentenced Monday to life in prison.

William McHenry, 37, left Club Z109 with Lucas McCauley on the night of Dec. 6, 2003, and went to McCauley's home, 1701 Valencia Drive, Largo. There, authorities said, McHenry stabbed McCauley to death.

McCauley, 30, spent his days working as a unit secretary at Morton Plant Hospital in Clearwater. At night, he frequented Club Z109 dressed as a woman named Reshae. The club caters to a gay and transgender clientele.

Law enforcement had considered the murder a possible hate crime, said Largo police Chief Lester Aradi. Monday's sentencing brought relief to those who were involved with the case.

"This was a particularly heinous crime and a very traumatic one for the victim," Aradi said.

Kim McCauley, Lucas' mother, found her son dead the next night in the living room of his apartment, which was next door to her home.

McHenry, who at the time was living with a 55-year-old female companion, was arrested and charged with murder within days of the slaying. After a four-day trial that started earlier this month, jurors found McHenry guilty.

Pinellas-Pasco Circuit Judge DeeAnna Farnell sentenced McHenry.

The murder sparked fear in the gay and transgender community. Shortly after the crime, Equality Florida, a gay advocacy organization, held a vigil for McCauley.

"With this particular case being brought to justice, it is certainly a step in the right direction," said Brian Winfield, communications director for Equality Florida. "It's good to see that at least in some cases, justice is served."

USGA Welcomes Trans Golfers

USGA Welcomes Trans Golfers

Laughing

By Cyd Zeigler Jr.

To little fanfare, the United States Golf Association this week adopted a policy to allow post-op transgender male-to-female golfers to participate in women’s tournaments.

Nary a whisper of it hit the airwaves. Not a peep was uttered about it on the Outsports.com discussion board. Even the guys on "Pardon The Interruption" missed it.

Sure, we’re talking about an incredibly miniscule number of people who might be affected. The number of transsexuals is a small fraction of the population; the number of transsexual golfers – well, I surely have more toes on one foot.

But, for heaven’s sake, the USGA is going to welcome transgender players on the women’s tour! This is the same organization that outwardly seems to try to quiet the lesbian talk surrounding its tours and still hasn’t seen a male pro come out. And they’re allowing former men to play on the women’s tour?

I can imagine the tears Danielle Swope shed when she heard the decision. Last summer, Swope, a hermaphrodite born with both male and female sexual organs, was denied in her request to play in a women’s event. Raised as Daniel, a boy, Swope underwent sex-reassignment surgery from 1995 to 1997 and has since lived as a woman.

The problem was that the USGA’s policy stated that, to play on the women’s tour, a golfer had to be “female at birth,” and that her birth certificate had to reflect that. Because Swope was outwardly male at birth, her birth certificate reflected that.

While the women’s tournament denied her request last July, she was invited to play in a men’s qualifier for the Fort Wayne Men's City Tournament. She was 5-foot-4 and weighed 160 pounds.

"I have respect for the men for at least giving me the opportunity to play,” she told the Associated Press at the time. “The women I don't have any respect for."

With the new policy, Swope, whose sex-reassignment surgery was now 10 years ago, and others like her will be able to compete on the women’s tour.

The USGA is certainly not the first. Golf has lead the rest of the sporting world in acceptance of transgender athletes. Australia’s Mianne Bagger has become the poster child for the cause. The female transgender golfer has participated in the Australian Women’s Open and just last month she made her European Tour debut. The International Olympic Committee has already opened the doors for transgender golfers.

On the surface, it’s surprising that the conservative sport of golf would be the first to open its country-club doors to transgender people. How could a sport that just recently began allowing black people in its clubs, still won’t let women join some clubs and keeps gay couples at bay be so progressive as to allow a former man to play on the woman’s tour?

While it may not make sense on the surface, there is logic to the madness.

A former man competing on a woman’s tour could be physiologically unfair. When testosterone is pumping through a person’s body for 20 or 30 years, that body is stronger than one that hasn’t had the luxury of that hormone. Of course, the USGA isn’t opening the door for every cross-dresser who likes to swing a golf club to enter women’s tour events; instead, the person must have had sex-reassignment surgery and must have been taking estrogen for at least two years.

According to Pauline Park, co-chair of the New York Association for Gender Rights Advocacy, the estrogen actually reduces some of the muscle the testosterone has built over the years.

"It's hard to generalize because it differs dramatically from individual to individual,” Park said. "But if someone is living as a post-op, male-to-female transsexual woman, who has significantly enhanced her levels of estrogen, then what advantages there are will be significantly diminished, if not, over time, eliminated."

While that might not be enough to open the doors to sports that are governed by speed and jumping ability, like basketball, soccer, track and field, volleyball and football, golf is the perfect place for sport to take its first step. In golf, the level of play between men and women is a lot more even than in these other sports. Speed and jumping are taken out of the equation. Even a certain lack of strength can be overcome with the right technique. As women have shown us in the last couple of years, they may not be able to win a men’s tournament yet, but they can compete in one.

Just think: While dozens or hundreds of men are injecting themselves with hormones to help improve their play in baseball, you have transgender females taking hormones to decrease their physical advantage.

And while many men are taking those steroids in a constant attempt to win that batting title or that elusive championship, the USGA need not worry about opening the flood gates.

"I can’t imagine we’ll see a lot of men rushing to have sex-assignment surgery so they can be champions on the women's tour,” Park said.

Or, as Outsports discussion-board member George_Twinsfan said, maybe Sergio Garcia has found the way for him to win a Major. Unless Danielle Swope stands in his way – she’s got to be even more hungry than he is.

In the Closet....Or Out?

June 18th, 2006 6:03 am MDT

So I told my mom. Finally. Was I nervous? Yah. Was I happy about it? Yah. So many mixed emotions led to this moment. Why did I wait? Have no Idea..after all I had told many people very early on in my life, including my dad. I told Syrissa after two dates.

So we sat down to lunch and she asked me what was going on were there any problems with Syrissa and I?  No ma. Did I need money. Yes ma but who couldn't? Then I told her. She had some questions. I answered them. She said she always thought there was something. I said there was. She asked for how long I was like this. I pointed out I was born with no adam's apple so my theory was that this has a lot to do with genetics. (She did a double take at the adam's apple comment!)

She told me she loved me and always wanted me to be happy. I told her that being able to share with her makes me happy! Now that My mom knows part of me feels like it doesn't matter who else does because everyone who is important to me does know. And that's what counts! Smile
